为深入推进电动自行车安全隐患全链条整治行动，保障电动自行车产品质量安全，现将加强电动自行车产品准入有关要求及行业规范管理工作措施公告如下：
一、严格执行强制性国家标准
现行的电动自行车安全强制性国家标准包括GB 17761—2018《电动自行车安全技术规范》、GB 42295—2022《电动自行车电气安全要求》、GB 42296—2022《电动自行车用充电器安全技术要求》、GB 43854—2024《电动自行车用锂离子蓄电池安全技术规范》等。
GB 42295—2022《电动自行车电气安全要求》第1号修改单、GB 42296—2022《电动自行车用充电器安全技术要求》第1号修改单、GB 43854—2024《电动自行车用锂离子蓄电池安全技术规范》将于2024年11月1日起实施。根据《中华人民共和国标准化法》第二十五条规定，自2024年11月1日起，不符合GB 42295—2022《电动自行车电气安全要求》及第1号修改单要求的电动自行车、装配充电器不符合GB 42296—2022《电动自行车用充电器安全技术要求》及第1号修改单的电动自行车、装配锂离子蓄电池不符合GB 43854—2024《电动自行车用锂离子蓄电池安全技术规范》的电动自行车不得生产、销售、进口。
市场监管总局将前述4项强制性国家标准及修改单，作为电动自行车强制性产品认证依据标准。根据《中华人民共和国认证认可条例》第二十七条，自2024年11月1日起，对新提出认证委托的电动自行车，应符合前述强制性国家标准及修改单要求，经过认证并标注认证标志后，方可出厂、销售、进口或者在其他经营活动中使用。认证委托人可自愿提前实施。
二、严格实施强制性产品认证
电动自行车强制性产品认证各指定认证机构应当严格依据前述4项强制性国家标准及修改单对电动自行车实施认证，及时修订完善认证实施规则，控制并验证获证产品与型式试验样品的一致性、生产企业的质量保证能力持续符合认证要求，对获证产品加大市场抽样检测或者检查力度，保证认证结论客观、真实并承担相应法律责任。
认证委托人对其已获得强制性产品认证的电动自行车，应在2024年10月31日前符合前述4项强制性国家标准及修改单要求并完成认证变更。逾期未完成认证变更的，指定认证机构对认证证书作出暂停处理，暂停期不超过3个月。认证委托人在2024年10月31日前主动提出暂停认证证书的，暂停期可延长至1年。暂停期内完成认证变更的，恢复认证证书有效；暂停期满仍不能完成认证变更的，撤销认证证书。
根据《强制性产品认证管理规定》第二十九条，获证产品被注销、暂停或者撤销认证证书的，认证机构应当确定不符合认证要求的产品类别和范围。自认证证书注销、撤销之日起或者认证证书暂停期间，不符合认证要求的产品，不得继续出厂、销售、进口或者在其他经营活动中使用。
三、强化电动自行车产品质量安全和认证监管
各地市场监管部门依据《中华人民共和国产品质量法》《中华人民共和国标准化法》《中华人民共和国认证认可条例》等法律法规，督促电动自行车生产销售单位全面落实质量安全主体责任，在生产、流通环节加强电动自行车产品质量监督检查，依法查处违法行为。聚焦认证质量，持续加强电动自行车认证活动、认证结果日常监督管理，督促认证机构及其认证人员对认证结果负责，依法查处违规认证机构、实验室。
四、强化电动自行车登记上牌管理
各地公安机关交管部门强化电动自行车登记上牌管理，严格核验销售发票、产品合格证和强制性产品认证证书等。2024年11月1日起，对2024年10月31日前销售的、因未完成认证变更而暂停认证证书的电动自行车可办理登记上牌；对2024年11月1日后销售的、不具有有效认证证书的电动自行车不予办理登记上牌，并将有关线索及时移送同级市场监管部门。
五、强化电动自行车行业规范管理
各地工业和信息化主管部门加强对电动自行车行业的管理，会同同级市场监管、消防等部门指导企业按照《电动自行车行业规范条件》要求，加快技术改造，规范各项管理，推动标准、认证的贯彻落实；做好本地区电动自行车企业规范公告申请的受理、核实和报送工作，监督检查本地区已进入公告名单企业《电动自行车行业规范条件》执行情况。对不能保持《电动自行车行业规范条件》要求的电动自行车企业，拒不整改或整改不合格的，工业和信息化部将其从公告名单中撤销。
各地电动自行车安全隐患全链条整治工作专班和有关部门要加强组织协调，压实各方责任，强化工作联动，切实提升电动自行车质量安全水平。

Content: In order to further promote the whole chain rectification action of electric bicycle safety hazards and ensure the quality and safety of electric bicycle products, the relevant requirements and industry standard management measures for strengthening the access of electric bicycle products are announced as follows:
1. Strictly implement mandatory national standards
The current mandatory national safety standards for electric bicycles include GB 17761-2018 "Safety Technical Specifications for Electric Bicycles", GB 42295-2022 "Electrical Safety Requirements for electric bicycles", GB 42296-2022 "Safety Technical Requirements for electric bicycle chargers" and GB 43854-2024 "Safety Technical Specification for lithium-ion Batteries for electric Bicycles", etc.
GB 42295-2022 "Electric Bicycle Electrical safety Requirements" No. 1 amendment, GB 42296-2022 "Electric bicycle Charger Safety Technical requirements" No. 1 amendment, GB 43854-2024 "Electric bicycle lithium-ion battery safety Technical specifications" will be implemented from November 1, 2024. According to Article 25 of the Standardization Law of the People's Republic of China, as of November 1, 2024, Electric bicycles and chargers that do not meet the requirements of GB 42295-2022 "Electric Bicycle Electrical safety Requirements" and No. 1 amendment order do not meet the requirements of GB 42296-2022 "Electric bicycle charger safety Technical requirements" and No. 1 amendment order electric bicycles and lithium-ion batteries do not meet the requirements of GB 43854-2024 "Safety Technical Specifications for Lithium-ion Batteries for Electric Bicycles" electric bicycles shall not be produced, sold or imported.
The General Administration of Market Supervision will be the above four mandatory national standards and amendments, as the electric bicycle mandatory product certification based on standards. According to Article 27 of the Regulations on Certification and Accreditation of the People's Republic of China, since November 1, 2024, the newly proposed certification of electric bicycles shall comply with the aforementioned mandatory national standards and amendment requirements, and be certified and marked with certification marks before they can be delivered, sold, imported or used in other business activities. The certification client may voluntarily implement it in advance.
Second, strictly implement mandatory product certification
Each designated certification body shall implement the certification of electric bicycles in strict accordance with the above four mandatory national standards and amendment sheets, revise and improve the implementation rules of certification in a timely manner, control and verify the consistency of certified products and type test samples, and the quality assurance ability of the production enterprise continues to meet the certification requirements. Strengthen market sampling testing or inspection of certified products, ensure that the certification conclusions are objective and true, and bear the corresponding legal responsibility.
For the electric bicycles that have obtained mandatory product certification, the certification client shall comply with the above four mandatory national standards and amendment requirements and complete the certification change before October 31, 2024. If the certification change is not completed within the time limit, the designated certification body shall suspend the certification, and the suspension period shall not exceed 3 months. If the certification client voluntarily proposes to suspend the certification before October 31, 2024, the suspension period can be extended to 1 year. If the certification change is completed during the suspension period, the certification certificate shall be valid again. If the change of certification cannot be completed after the suspension period expires, the certification certificate shall be revoked.
According to Article 29 of the Provisions on the Administration of Mandatory Product Certification, where a certified product is cancelled, suspended or revoked, the certification body shall determine the category and scope of the product that does not meet the certification requirements. From the date of cancellation or revocation of the certification certificate or the period of suspension of the certification certificate, products that do not meet the certification requirements may not continue to be delivered, sold, imported or used in other business activities.
Third, strengthen the quality safety and certification supervision of electric bicycle products
Local market supervision departments in accordance with the "People's Republic of China Product Quality Law", "Standardization Law of the People's Republic of China" and "Certification and accreditation Regulations of the People's Republic of China" and other laws and regulations, urge electric bicycle production and sales units to fully implement the main responsibility for quality and safety, strengthen the quality supervision and inspection of electric bicycle products in the production and circulation links, and investigate and punish illegal acts according to law. Focus on the quality of certification, continue to strengthen the electric bicycle certification activities, the daily supervision and management of certification results, urge the certification body and its certification personnel to be responsible for the certification results, and investigate and punish the violation of certification bodies and laboratories according to law.
Fourth, strengthen the registration and registration management of electric bicycles
The traffic management departments of local public security organs strengthen the registration and licensing management of electric bicycles, and strictly verify sales invoices, product certificates and mandatory product certification certificates. From November 1, 2024, electric bicycles sold before October 31, 2024, which have suspended their certification certificates due to incomplete certification changes can be registered and licensed; Electric bicycles sold after November 1, 2024, that do not have a valid certification shall not be registered and licensed, and the relevant clues shall be promptly transferred to the market regulatory authorities at the same level.
Fifth, strengthen the electric bicycle industry standard management
Local industrial and information technology authorities to strengthen the management of the electric bicycle industry, together with the market supervision, fire and other departments at the same level to guide enterprises in accordance with the requirements of the "electric bicycle industry standard Conditions", speed up technological transformation, standardize the management, and promote the implementation of standards and certifications; Do a good job of accepting, verifying and submitting the application for normative announcement of electric bicycle enterprises in the region, and supervise and inspect the implementation of the "Normative Conditions for electric Bicycle Industry" of enterprises that have entered the announcement list in the region. For those electric bicycle enterprises that cannot maintain the requirements of the "Electric Bicycle Industry Standard Conditions", refuse to rectify or fail to rectify, the Ministry of Industry and Information Technology will withdraw it from the announcement list.
The whole chain rectification work of electric bicycle safety hazards around the special class and relevant departments should strengthen organization and coordination, consolidate the responsibilities of all parties, strengthen work linkage, and effectively improve the quality and safety level of electric bicycles.
