《划分规定》是我国开发、利用、保护无线电频谱资源的基础性行政规章,对促进无线电频谱资源合理和有效使用,引导无线电产业高质量发展发挥着重要作用。工业和信息化部依据国际电信联盟《无线电规则》,统筹考虑各部门、各行业对频谱资源的中长期需求,定期组织对《划分规定》进行修订。
在本次《划分规定》修订中,工业和信息化部率先在全球将6425-7125MHz全部或部分频段划分用于IMT(国际移动通信,含5G/6G)系统。6GHz频段是中频段仅有的大带宽优质资源,兼顾覆盖和容量优势,特别适合5G或未来6G系统部署,同时可以发挥现有中频段5G全球产业的优势。此次以规章形式确定其规则地位,有利于稳定5G/6G产业预期,推动5G/6G频谱资源全球或区域划分一致,为5G/6G发展提供所必需的中频段频率资源,促进移动通信技术和产业创新发展。

问:《划分规定》修订的背景是什么?
答:《划分规定》是依法管理无线电频谱资源的重要依据,对促进无线电频谱资源合理和有效使用发挥着重要作用。《划分规定》历次修订主要是与国际电信联盟每3~4年召开一次的世界无线电通信大会修订的《无线电规则》相衔接,并进一步满足国内频谱使用需求。2019年,世界无线电通信大会修改了有关国际无线电频率的划分,形成了《无线电规则》(2020年版)。同时,近年来,移动通信、航天工程、汽车雷达等产业的发展也对频率使用提出了新的需求。为了做好与《无线电规则》(2020年版)的衔接,同时协调保障各相关部门、行业对频谱资源的中长期需求,亟需对现行《划分规定》进行修订。
问:《划分规定》修订过程中,主要开展了哪些工作?
答:在修订过程中,主要开展了以下工作:一是通过开展实地调研、座谈会等方式,充分听取无线电频率使用相关部门及企事业单位意见,并对重点问题进行深入研究。二是书面征求国务院有关部门及有关企业的意见,并向社会公开征求意见。结合各方面反馈意见,组织召开座谈会,再次听取有关方面的意见。三是认真研究各方面意见,完善有关制度,形成《划分规定(修订草案)》。
2023年4月26日,工业和信息化部部务会议审议通过了《划分规定(修订草案))》。
问:《划分规定》修订了哪些内容?
答:《划分规定》主要修订了以下内容:
《划分规定》包括总则、正文和附录三个部分。根据《无线电规则》(2020年版)修订情况和我国国内协调结果,主要作出如下修改:一是关于定义。修改“制式无线电台”等3个定义,新增“无线电力传输”“空间监视雷达”“气象雷达”等11个定义,新增字母代码为“Q/V”“E”“W”的使用频段和范围。二是关于具体划分。对无线电频率划分表进行修订,共涉及12种无线电业务、71个频段。三是关于脚注。针对国际脚注的修订有159条(其中,修改132条、新增24条、废止3条),针对中国脚注的修订有13条(其中,修改6条、新增7条)。四是关于附录。对附录中发射机频率容限、发射设备杂散域发射功率限值要求、发射标识和必要带宽进行了修订。
问:《划分规定》修订形成哪些主要成果?
答:一是新增IMT(国际移动通信,含5G/6G)系统频率划分。在6GHz、26GHz、40GHz、70GHz等频段为IMT系统新增频率划分,为5G/6G系统频率使用提供规则地位,稳定产业预期。在全球率先将6GHz频段划分用于IMT系统,有利于推动该频段全球或区域频率划分一致,为5G/6G发展提供充足的中频段频率资源。
二是支持卫星通信可持续发展。在150MHz和400MHz频段分别设立卫星水上移动和卫星移动业务规则条款,在17.7-19.7 GHz和27.5-29.5 GHz频段引入卫星动中通地球站使用,在37.5-51.4 GHz中部分频段明确了非对地静止轨道卫星系统使用条件,为卫星通信频率使用提供规则地位。
三是保障重大航天工程等频率使用安全。在相关频段和部分区域,明确了对卫星地球探测、空间研究、射电天文等无线电业务的干扰保护,为重大航天工程、科学研究等频率使用提供了规则保障。
四是规范引导汽车雷达产业发展。本次修订明确79-81GHz频段无线电定位业务将优先用于汽车雷达等应用,为汽车智能化技术应用和产业发展预留频谱资源,支持汽车行业长远发展。

The Division Provisions include three parts: general provisions, main body and appendix. Modify 3 definitions such as "standard radio station", add 11 definitions such as "wireless power transmission", "space surveillance radar" and "weather radar", and add the frequency band and range of the letter code "Q/V", "E" and "W".
