900MHz频段射频识别(RFID)设备无线电管理规定

 

第一条 为促进无线电产业发展,加强射频识别(RFID)设备的管理,提高频谱使用效率,维护空中电波秩序,根据《中华人民共和国无线电管理条例》《中华人民共和国无线电频率划分规定》《无线电发射设备管理规定》等法规规章,制定本规定。

 

第二条 本规定所称射频识别(RFID)技术,是指通过对射频信号进行调制和编码,实现读写器与标签之间非接触式的数据传输,进而识别标签所含身份信息等数据的技术,主要应用于公共安全、生产管理与控制、物流和供应链管理、交通管理等领域。

 

本规定适用于920-925MHz频段射频识别(RFID)无线电发射设备的研制、生产、进口、销售和使用。

 

第三条 生产或者进口在国内销售、使用的射频识别(RFID)无线电发射设备应当符合“900MHz频段射频识别(RFID)无线电发射设备技术要求”(见附件),并向国家无线电管理机构申请无线电发射设备型号核准。

 

第四条 设置、使用920-925MHz频段射频识别(RFID)无线电发射设备,参照地面公众移动通信终端管理,无需取得无线电台执照。

 

第五条 使用射频识别(RFID)无线电发射设备,不得对其他合法的无线电台(站)产生有害干扰,也不得提出免受有害干扰的保护要求,如对其他合法无线电台(站)产生有害干扰时,应立即停止使用,并在采取措施消除有害干扰后方可继续使用。

 

第六条 在距铁路轨道中心线最短水平距离33米范围内设置920-925MHz频段射频识别(RFID)无线电发射设备,应征得国家铁路局或地区铁路监督管理局同意。

 

第七条 无线电管理机构应加强对生产、进口、销售、使用射频识别(RFID)无线电发射设备的监督检查,发现违反无线电管理有关规定的应责令改正并依法处理。

 

第八条 自本规定施行之日起,国家无线电管理机构不再受理和审批840-845MHz频段射频识别(RFID)无线电发射设备型号核准申请,已获得该频段型号核准证的射频识别(RFID)无线电发射设备可以继续销售和使用到报废为止。

 

第九条 本规定自2024年11月1日起施行,原《800/900MHz频段射频识别(RFID)技术应用规定(试行)》(信部无〔2007〕205号)同时废止。

《900MHz频段射频识别(RFID)设备无线电管理规定》解读


近日,工业和信息化部发布了《900MHz频段射频识别(RFID)设备无线电管理规定》(以下简称《规定》)。为更好地理解和落实《规定》,现就有关内容解读如下:


一、为什么要制定《规定》?


2007年,原信息产业部发布《800/900MHz频段射频识别(RFID)技术应用规定(试行)》(信部无〔2007〕205号),明确了 RFID 设备属性、技术要求,对促进RFID设备产业发展发挥了积极作用。近年来,随着RFID设备技术发展和规模应用,上述规定已不能完全适应RFID设备管理的需要。一是900MHz频段能够满足 RFID 设备产业需求,国内外RFID设备已基本不再使用800MHz频段,800MHz频段腾退后可重新规划使用,有利于频谱资源的合理有效利用。二是工业和信息化部发布的2019年第52号公告更新了微功率短距离无线电发射设备目录,未将RFID设备列入微功率设备范畴,需进一步明确RFID设备属性及管理模式。三是制定《规定》适应产业发展及行业应用需求,有助于尽早形成产业预期。


二、《规定》制定过程中开展了哪些工作


《规定》主要依据《中华人民共和国无线电管理条例》《中华人民共和国无线电频率划分规定》《无线电发射设备管理规定》等法规规章,并参考了国际电信联盟《无线电规则》等相关规定,在保障现有无线电业务的基础上,充分考虑产业现状和发展趋势。


在制定过程中,主要开展了以下工作:一是广泛调研国内外相关政策以及产业需求,开展同、邻频段无线电系统的频率兼容共存研究,组织射频技术特性测试验证工作。二是向社会公开征求意见,并书面征求地方无线电管理机构、国务院有关部门等单位意见。三是认真研究各方面意见,对反映较为集中的问题先后召开多次产业界专题协调会,形成《规定》(草案)。


三、《规定》作出了哪些调整


《规定》主要在管理政策和技术要求两方面对原规定进行了调整,具体如下:


在管理政策方面。一是考虑到RFID产业发展趋势和频率使用情况,本次修订不再保留原规定中的840-845MHz频段,明确 RFID设备工作频率为920-925MHz。二是明确RFID设备参照地面公众移动通信终端管理,需取得无线电发射设备型号核准(以下简称型号核准)证,但无需取得无线电台执照。RFID 设备不得对其他合法的无线电台(站)产生有害干扰,也不得提出免受有害干扰的保护要求。三是增加对邻频铁路专用频率的保护,即在距铁路轨道中心线最短水平距离33米范围内设置920-925MHz频段RFID设备时,应征得国家铁路局或地区铁路监督管理局同意。


在技术要求方面。一是考虑国际移动通信(IMT)技术发展以及广播电视业务保护需求,调整了相关频段杂散发射限值。二是新增接收机阻塞限值,以提升RFID 设备抗干扰能力。


四、《规定》与原规定如何衔接


考虑到800MHz频段RFID 设备已基本退出市场,《规定》中900MHz频段RFID 设备相关技术要求较原规定无较大调整,对现有产业影响较小,经与产业界充分沟通,《规定》自2024年11月1日起施行,原规定同时废止。即在2024年11月1日前,对于符合原规定而不符合本《规定》所列技术要求的设备,仍可按照原规定申请型号核准或延期;自2024年11月1日起,RFID设备须满足本《规定》相关技术要求,不再受理和审批不符合本《规定》所列技术要求的 RFID 设备型号核准申请,已获得型号核准证的 RFID 设备可以继续销售和使用到报废为止。

The Regulations on Radio Management of Radio Frequency Identification (RFID) Equipment in the 900MHz Band are hereby issued to you, please follow them carefully.


900MHz band Radio Frequency identification (RFID) equipment radio management regulations


Article 1 In order to promote the development of the radio industry, strengthen the management of radio frequency identification (RFID) equipment, improve the efficiency of spectrum use, and maintain the order of air waves, these Provisions are formulated in accordance with the Regulations of the People's Republic of China on Radio Administration, the Regulations of the People's Republic of China on the Division of Radio Frequencies, and the Regulations on the Administration of Radio Transmission Equipment, etc.


Article 2 The radio frequency identification (RFID) technology referred to in these provisions refers to the non-contact data transmission between the reader and the label through the modulation and coding of the radio frequency signal, so as to identify the identity information contained in the label and other data technology, mainly used in public security, production management and control, logistics and supply chain management, traffic management and other fields.


This regulation applies to the development, production, import, sale and use of radio frequency identification (RFID) radio transmitting equipment in the 920-925MHz band.


Article 3 The radio frequency identification (RFID) radio transmission equipment produced or imported for domestic sale and use shall meet the "Technical requirements for radio frequency identification (RFID) radio transmission equipment in the 900MHz band" (see annex), and apply to the national radio regulatory authority for the type approval of radio transmission equipment.


Article 4 Setting up and using radio frequency identification (RFID) radio transmission equipment in the 920-925MHz band shall refer to the management of ground public mobile communication terminals, and it is not necessary to obtain a radio station license.


Article 5 The use of radio frequency identification (RFID) radio transmission equipment shall not cause harmful interference to other lawful radio stations (stations), nor shall it put forward protection requirements from harmful interference, such as harmful interference to other lawful radio stations (stations), shall immediately stop use, and can continue to use after taking measures to eliminate harmful interference.


Article 6 The setting of 920-925MHz frequency band radio frequency identification (RFID) radio transmission equipment within the minimum horizontal distance of 33 meters from the center line of the railway track shall be approved by the National Railway Administration or the regional railway Supervision Administration.


Article 7 The radio regulatory authority shall strengthen the supervision and inspection of the production, import, sale and use of radio frequency identification (RFID) radio transmission equipment, and shall order corrections and handle according to law if it is found that it violates the relevant provisions of radio management.


Article 8 As of the date of implementation of these provisions, the national radio regulatory authority will no longer accept and approve the application for type approval of radio frequency identification (RFID) radio transmission equipment in the 840-845MHz band, and the radio frequency identification (RFID) radio transmission equipment that has obtained the type approval certificate of the frequency band can continue to be sold and used until scrapped.


Article 9 These provisions shall come into force as of November 1, 2024, and the original "Regulations on the Application of Radio Frequency Identification (RFID) Technology in 800/900MHz Band (Trial)" (No. 205, 2007) shall be repealed at the same time.

Interpretation of the Radio Management Regulations for 900MHz Radio Frequency Identification (RFID) Equipment


Recently, the Ministry of Industry and Information Technology issued the "900MHz Band Radio Frequency Identification (RFID) equipment Radio Management Regulations" (hereinafter referred to as the "Regulations"). In order to better understand and implement the Provisions, the relevant contents are interpreted as follows:


1, why are the Regulations formulated?


In 2007, the former Ministry of Information Industry issued the "800/900MHz Frequency band Radio Frequency Identification (RFID) technology application Regulations (Trial)" (Ministry of Information No. 205 (2007)), which clarified the attributes and technical requirements of RFID equipment, and played a positive role in promoting the development of RFID equipment industry. In recent years, with the development of RFID equipment technology and scale applications, the above provisions have been unable to fully meet the needs of RFID equipment management. First, the 900MHz frequency band can meet the needs of the RFID equipment industry, and domestic and foreign RFID equipment has basically no longer used the 800MHz frequency band, and the 800MHz frequency band can be re-planned and used after the retreat, which is conducive to the reasonable and effective utilization of spectrum resources. Second, Announcement No. 52 in 2019 issued by the Ministry of Industry and Information Technology updated the catalogue of micro-power short-distance radio transmission equipment, and did not include RFID equipment in the category of micro-power equipment, and it is necessary to further clarify the attributes and management mode of RFID equipment. The third is to formulate the "Regulations" to adapt to industrial development and industry application needs, and help form industry expectations as soon as possible.


2. What has been done in the process of formulating the Regulations?


The Provisions are mainly based on the Regulations of the People's Republic of China on Radio Administration, the Regulations of the People's Republic of China on the Division of Radio Frequencies, the Regulations on the Management of Radio Transmitting Equipment and other regulations, and refer to the relevant provisions of the International Telecommunication Union's Radio Regulations, and fully consider the current situation and development trend of the industry on the basis of protecting the existing radio services.


In the process of formulation, the following work was mainly carried out: First, extensive research on relevant policies and industrial needs at home and abroad, research on frequency compatibility and coexistence of radio systems in the same and adjacent frequency bands, and organization of RF technology characteristics testing and verification work. The second is to solicit opinions from the public, and to solicit opinions from local radio regulatory agencies and relevant departments of The State Council in writing. The third is to carefully study the opinions of all aspects, to reflect the more concentrated issues have held a number of industry coordination meetings, the formation of the "Provisions" (draft).


3. What adjustments have been made to the Provisions?


The Provisions mainly adjust the original provisions in two aspects of management policies and technical requirements, specifically as follows:


In management policy. First, taking into account the development trend of the RFID industry and frequency use, this revision no longer retains the 840-845MHz band in the original provisions, and it is clear that the working frequency of RFID equipment is 920-925MHz. Second, it is clear that the RFID equipment refers to the management of the ground public mobile communication terminal, and it is necessary to obtain the radio transmission equipment model approval (hereinafter referred to as model approval) certificate, but it is not necessary to obtain the radio station license. RFID devices shall not cause harmful interference to other legitimate radio stations (stations), nor shall they require protection from harmful interference. The third is to increase the protection of the special frequency of the adjacent frequency railway, that is, when the 920-925MHz frequency band RFID equipment is set within the minimum horizontal distance of 33 meters from the center line of the railway track, the National Railway Administration or the regional railway Supervision Administration should be agreed.


In terms of technical requirements. First, considering the development of international mobile communication (IMT) technology and the protection needs of radio and television services, the relevant frequency band stray emission limits are adjusted. The second is to add a new receiver blocking limit to improve the anti-interference ability of RFID equipment.


4. How are the Provisions connected with the original provisions?


Considering that the 800MHz band RFID equipment has basically withdrawn from the market, the relevant technical requirements of the 900MHz band RFID equipment in the "Regulations" have no major adjustments compared with the original provisions, and the impact on the existing industry is small, after full communication with the industry, the "Regulations" will be implemented from November 1, 2024, and the original provisions will be repealed at the same time. That is, before November 1, 2024, for equipment that meets the original provisions but does not meet the technical requirements listed in this Regulation, it can still apply for type approval or extension in accordance with the original provisions; Since November 1, 2024, RFID equipment must meet the relevant technical requirements of these Regulations, no longer accept and approve the application for model approval of RFID equipment that does not meet the technical requirements listed in these Regulations, and the RFID equipment that has obtained the model approval certificate can continue to be sold and used until scrapped.
