内容(Content)：近日，工业和信息化部发布了《无线电发射设备监督检查办法》（以下简称《办法》）。为更好地落实《办法》有关要求，现就有关内容解读如下：
一、为什么要制定《办法》？
（一）进一步加强事中事后监管
按照《国务院关于加强和规范事中事后监管的指导意见》（国发〔2019〕18号）有关要求，通过制定《办法》加快构建权责明确、公平公正、公开透明、简约高效的事中事后监管体系，推进依法行政，提高监管效能。
（二）进一步规范行政执法工作
《办法》对现有无线电发射设备“双随机、一公开”检查、销售巡检、入境监管以及型号核准申请企业检查等工作规定进行全面梳理整合，对监督检查过程中的行政执法行为进行统一规范。
（三）进一步维护空中电波秩序
通过《办法》的实施，实现对无线电发射设备全环节的监督检查，有利于增强企业守法意识和质量意识，规范研制、生产、销售、维修等行为，防范非法无线电发射设备入境，提升无线电发射设备使用的合法合规性，维护空中电波秩序。
二、《办法》制定过程中开展了哪些工作？
《办法》主要依据《中华人民共和国行政许可法》《中华人民共和国电子商务法》《中华人民共和国无线电管理条例》《无线电发射设备管理规定》等法律、法规和规章制定。在制定过程中，主要开展了以下工作：一是在充分调研无线电发射设备产业现状和发展趋势，系统梳理无线电发射设备监督检查有关工作情况的基础上，启动了《办法》的起草工作。二是向国务院相关部门、地方无线电管理机构、型号核准检测机构、行业协会、重点生产销售企业以及社会公开征求意见，组织专家论证，充分吸纳各方意见。
三、《办法》的发布对无线电产业会产生哪些影响？
无线电发射设备管理关乎无线电产业高质量发展，《办法》的制定是对现有的监督检查工作进行梳理整合，要求避免对检查对象重复检查，提高监管效能，严格规范和有力监管罚款设定与实施，减轻企业负担，维护企业合法权益。《办法》的发布将推动无线电频谱资源科学、有效利用，积极营造良好产业发展环境，促进无线电产业健康有序发展。
四、《办法》什么时间施行？
2024年9月1日起施行。

subject: Interpretation of the Measures for Supervision and Inspection of Radio Transmission Equipment
Recently, the Ministry of Industry and Information Technology issued the "Measures for Supervision and Inspection of Radio Transmission Equipment" (hereinafter referred to as the "Measures"). In order to better implement the relevant requirements of the Measures, the relevant contents are interpreted as follows:
First, why are the Measures formulated?
1. We will further strengthen in-process and post-event oversight
In accordance with the relevant requirements of the Guiding Opinions of The State Council on Strengthening and standardizing in-process and Post-event Supervision (Guofa [2019] No. 18), we will accelerate the construction of an in-process and post-event supervision system with clear powers and responsibilities, fairness, openness and transparency, simplicity and efficiency through the formulation of the Measures, promote law-based administration, and improve supervision efficiency.
2. Further standardizing administrative law enforcement
The Measures comprehensively sort out and integrate the work regulations on the "double random and one open" inspection, sales inspection, entry supervision and inspection of enterprises applying for model approval of existing radio transmission equipment, and standardize the administrative law enforcement behaviors in the supervision and inspection process.
(3) Further maintain the order of air waves
Through the implementation of the Measures, the supervision and inspection of the whole link of radio transmission equipment is realized, which is conducive to enhancing the law-abiding awareness and quality awareness of enterprises, standardizing the development, production, sales, maintenance and other behaviors, preventing the entry of illegal radio transmission equipment, improving the legal compliance of the use of radio transmission equipment, and maintaining the order of air waves.
2. What has been done in the process of formulating the Measures?
The Measures are formulated mainly in accordance with the Administrative Licensing Law of the People's Republic of China, the Electronic Commerce Law of the People's Republic of China, the Radio Administration Regulations of the People's Republic of China, and the Regulations on the Administration of Radio Transmission Equipment. In the process of formulation, the following work was mainly carried out: First, on the basis of fully investigating the status quo and development trend of the radio transmission equipment industry and systematically sorting out the relevant work of the supervision and inspection of radio transmission equipment, the drafting of the "Measures" was started. The second is to solicit opinions from relevant departments of The State Council, local radio regulatory agencies, model approval and testing agencies, industry associations, key production and sales enterprises and the public, organize experts to demonstrate, and fully absorb the opinions of all parties.
3. What impact will the release of the Measures have on the radio industry?
The management of radio transmission equipment is related to the high-quality development of the radio industry, and the formulation of the "Measures" is to sort out and integrate the existing supervision and inspection work, requiring to avoid repeated inspections of inspection objects, improve regulatory efficiency, strictly standardize and effectively supervise the setting and implementation of fines, reduce the burden on enterprises, and safeguard the legitimate rights and interests of enterprises. The release of the Measures will promote the scientific and effective use of radio spectrum resources, actively create a good environment for industrial development, and promote the healthy and orderly development of the radio industry.
4. When will the Measures come into effect?
Effective September 1, 2024.
