MIC issued the circular 02/2024/TT-BTTTT to modify the 04/2023/TT-BTTTT.

No English version is available until now, some key points summarized as below:
1. Effected from May 15,2024
2. SRDs imported for importer using purpose are exempted from TAC and AQI if the quantity less than 3 models per each type in each imported lot. The frequency, RF outpower, spurious emission on technical data sheet must comply with 08/2021/TT-BTTTT
3. Laptop, notebook, Desktop PC are exempted from QCVN 101 (battery) and QCVN 132 (safety) if the quantity in 1 imported lot less than 3 models per each type. The importer need to sign a letter of guarantee that devices are compatible with all or some items in QCVn 101 and/or QCVN 132 and ready to take responsibility for safety of imported product
c) Trong vòng mười lăm (15) ngày làm việc kể từ ngày thông quan, tổ chức, cá nhân nhập khẩu phải nộp cho Cục Viễn thông kết quả tự đánh giá sự phù hợp theo quy định tại điểm đ khoản 1 Điều 17 Thông tư này (đối với trường hợp công bố hợp quy theo điểm a khoản 2 Điều 7 Nghị định số 132/2008/NĐ-CP ngày 31 tháng 12 năm 2008 được sửa đổi tại khoản 3 Điều 1 Nghị định số 74/2018/NĐ-CP ngày 15 tháng 5 năm 2018) hoặc kết quả chứng nhận theo quy định tại điểm d khoản 1 Điều 17 Thông tư này được cấp bởi tổ chức chứng nhận hợp quy hoặc tổ chức chứng nhận được thừa nhận theo quy định của pháp luật (đối với trường hợp công bố hợp quy theo điểm b khoản 2 Điều 7 Nghị định số 132/2008/NĐ-CP ngày 31 tháng 12 năm 2008 được sửa đổi tại khoản 3 Điều 1 Nghị định số 74/2018/NĐ-CP ngày 15 tháng 5 năm 2018).
Note: The imported cell phones for importer using purpose are still exempted from TAC/DoCs as shown in 30/2011/TT-BTTTT but in this regulation, the is no quantity limitation. According to our experience of working with the customs, we should not import more than 2 pieces per lot.
4. Besides the current columns (type of product, applied QCVNs, HS Code, goods description) MIC added one more column to show the time to apply QCVNs and/or the items of QCVN can be temporarily exempted in a specific duration. This one is very long, you can see the tabel for detailed information but I can give you some major points.
-QCVN 55:2023/BTTTT, QCVN 110:2023/BTTTT, QCVN 111:2023/BTTTT can be voluntarily applied from May 15, 2024 ealier than required before (on Jul 1, 2024 )
- Keep not applying some items such as TRP, TRS, base station performance...
- Testing items in extreme conditions can be exempted with the following date
+QCVN 117:2020 , QCVN 55: 2011 (SRD from 9kHz to 25MHz): until Jul 1, 2024.
+QCVN 117:2023/BTTTT (2-3-4G device), QCVN 127:2021/BTTTT(5G SA device) , QCVN 129:2021/BTTTT (5G NSA device), QCVN 122:2020 (LPWAN), QCVN 55: 2023 (SRD from 9kHz to 25MHz), QCVN54:2020 + QCVN 65:2021 (for wifi device except wireless access point, wireless modem/gateway/router): until Jul 1, 2025
- QCVN 123: 2021: SRD 40-246 GHz: is totally exempted until Jul 1, 2025.
- QCVN 55:2023/BTTTT is not required for wireless charging devices
- 5G NR mobile phones are required to support both SA and NSA mode. TAC for 5G NR terminal equipment with only one mode will be in valid from Jul 1, 2024. 5G NR cell phones must support the frequency bands specified in QCVN 127:2021/BTTTT
- Chassis report on QCVN 63:2020/BTTTT can be used for AQI purpose of completed DVB-T2 TV set. The chassis definition is show clearly.
· Public land mobile service Terminal equipment but not cell phone must support LTE from Jul 1, 2024, all issed TAC for device without LTE will be invalid after Jun 30, 2025.
5. Show the type of documents required if the there is WiFi 6E, WiFi 7, in the imported goods : manufacturer (of the completed host) must sign a letter to confirm the 6GHz (5.925-7.125 GHz) disabling and user can not enable this band without manufacturer (of the completed host) support.
6. The AQI iussed from January 1, 2024 to May 15, 2024, the importer can complete the AQI according to the Circular No. 04/2023/TT-BTTTT and Circular 10/2023/TT-BTTTT or of 02/2024/ TT-BTTTT
