为更好理解和落实《暂行办法》相关要求,工业和信息化部无线电管理局相关负责 人对《暂行办法》进行了解读。
一、《暂行办法》制定的背景是什么?
民用无人驾驶航空器实现遥控、遥测、信息传输等功能均需要使用无线电频率,为 了加强民用无人驾驶航空器无线电管理工作,工业和信息化部于 2015 年发布了《关于 无人驾驶航空器系统频率使用事宜的通知》,为民用无人驾驶航空器遥控、遥测和信 息传输提供了频率资源保障。
随着民用无人驾驶航空器产业快速发展,新技术新应用对频率使用需求不断增加, 《无人驾驶航空器飞行管理暂行条例》等上位法对涉及民用无人驾驶航空器无线电管 理事宜提出具体要求,因此有必要制定无线电管理配套政策,进一步落实上位法要求, 细化明确无线电管理政策,规范民用无人驾驶航空器系统无线电发射设备生产、进口、 销售,以及无线电频率使用、无线电台设置使用等工作。
二、制定《暂行办法》的主要考虑有哪些?
在制定《暂行办法》过程中,我们从更好满足民用无人驾驶航空器通信系统频率使 用新情况新需求、支持产业发展、方便用户使用等方面着手,重点有如下几方面考虑:
一是明确管理范畴。进一步明确将民用无人驾驶航空器通信系统无线电发射设备型 号核准、无线电频率使用、无线电台设置使用纳入无线电管理范畴,使管理政策与上 位法有效衔接。
二是细化管理要求。进一步明确民用无人驾驶航空器通信系统无线电发射设备管理 要求,优化调整了民用无人驾驶航空器通信系统遥控、遥测、信息传输以及探测、 自 主避障等可用频率范围,明确民用无人驾驶航空器通信系统无线电台执照办理要求, 并对搭载其他无线电台(站)等事项作出规定。
三是突出简政放权。进一步明确微功率短距离民用无人驾驶航空器通信系统无线电 发射设备无需取得型号核准、频率使用许可和无线电台执照;明确部分民用无人驾驶 航空器系统无线电台按照地面公众移动通信终端管理,无需取得无线电台执照,进一 步简政放权,方便用户使用,促进产业发展。
四是加强使用监管。进一步明确民用无人驾驶航空器通信系统无线电台使用过程中 无线电干扰处理原则、无线电管制、监督检查、遵守其他部门规定以及相应法律责任
等内容。同时,通过制定过渡政策,保证生产制造企业和用户权益,保障相关上下游 产业链的韧性与稳定。
三、《暂行办法》制定过程中,主要开展了哪些工作?
在《暂行办法》制定过程中,主要开展了以下工作:一是开展相关课题研究、国内 外政策梳理和行业调研,形成《暂行办法(初稿)》。二是多次向部内外单位、相关 技术支撑机构、行业协会征求意见,组织政府部门、行业协会、民用无人驾驶航空器 系统生产制造企业、用户代表开展座谈交流,形成《暂行办法(公开征求意见稿)》。 三是两次公开征求意见,就反映集中的意见建议进行专题研究、开展技术分析,实地 听取各方意见后,采纳并修改形成《暂行办法(审议稿)》。四是开展专家论证、完 成文件发布前相关审查工作后印发。
四、《暂行办法》的主要内容有哪些?
《暂行办法》由 5 章、24 条和 1 个附件组成。
第一章为总则,主要明确了文件制定依据、定义、适用范围。
第二章为民用无人驾驶航空器通信系统无线电频率、台站管理,主要明确了民用无 人驾驶航空器通信系统可使用无线电频率范围、无线电频率使用和相关台站设置使用 许可等事宜。
第三章为民用无人驾驶航空器通信系统无线电发射设备管理,主要对型号核准、销 售备案、临时进关等作出要求。
第四章为电波秩序维护,主要明确民用无人驾驶航空器通信系统无线电台日常使用、 管制、干扰处置、法律责任等内容。
第五章为附则,主要明确了涉外情形、过渡政策等事宜。
附件主要规定了民用无人驾驶航空器通信系统无线电发射设备相关射频技术指标 和要求。

In order to strengthen radio management of civil unmanned aerial vehicles (UAVs), the Ministry of Industry and Information Technology issued the Notice on the Use of UAVs System Frequency in 2015. It provides frequency resources for remote control, telemetry and information transmission of civil unmanned aircraft.
With the rapid development of the civil unmanned aerial vehicle industry and the increasing demand for frequency use due to new technologies and applications, the Interim Regulations on the Flight Management of Unmanned Aerial Vehicles and other upper laws put forward specific requirements for radio management of civil unmanned aerial vehicles. Therefore, it is necessary to formulate supporting policies for radio management to further implement the requirements of the upper Law. Specify and clarify radio management policies, and regulate the production, import and sale of radio transmission equipment for civil unmanned aircraft systems, as well as the use of radio frequencies and the setting and use of radio stations.
2. What are the main considerations in formulating the Interim Measures?
In the process of formulating the "Interim Measures", we started from the aspects of better meeting the new situation and new needs of the frequency use of civil unmanned aircraft communication systems, supporting industrial development, and facilitating user use, focusing on the following considerations:
First, define the scope of management. Further explicitly include the type approval of radio transmission equipment for civil unmanned aircraft communication systems, the use of radio frequencies, and the setting and use of radio stations in the scope of
radio management, so as to effectively link management policies with the upper Law.
The second is to refine management requirements. Further clarify the management requirements for radio transmission equipment of the civil unmanned aircraft communication system, optimize and adjust the frequency range available for remote control, telemetry, information transmission, detection, autonomous obstacle avoidance of the civil unmanned aircraft communication system, and clarify the requirements for the radio station license of the civil unmanned aircraft communication system. 3. In the process of formulating the Interim Measures, what work has been carried out?

The second chapter is the radio frequency and station management of the civil unmanned aircraft communication system, which mainly clarifies the radio frequency range that can be used by the civil unmanned aircraft communication system, the use of radio frequency and the permission of the relevant stations.
The third chapter is the management of radio transmission equipment of civil unmanned aircraft communication system, which mainly makes requirements for model approval, sales record, temporary entry and so on.
The fourth chapter is the maintenance of radio wave order, mainly clarifying the daily use, control, interference disposal, legal liability and other contents of the radio station of the civil unmanned aircraft communication system.
The fifth chapter is the supplementary provisions, which mainly clarifies the foreign-related situation, transitional policy and other matters.
